IT MAY YET AGAIN BECOME A POLICE MATTER (HIDING DONNELLY’S DEFICIT)

So the Trust committee wants to hand over to the club some ten thousand  pounds raised in good faith for The Greenock Morton F.C. Inverclyde Football Academy Ltd!

In response to Mortonjag’s legitimate concerns, accountant ‘Piniccio’ Robinson has yet again been fiddling with facts, and in typically dictatorial fashion ramming his version down the throats of a gullible minority .

Here’s the latest public statement from the ‘vastly experienced forensic accountant’ who can’t do simple arithmetic:

 ‘Finally, I would like to say that the whole question funding the youth academy has been raised at this time with an ulterior motive which is nothing to do with any philanthropic concerns for the youth academy or any real concerns about diverted funds. Everyone knows why certain parties are interested in denuding the Trust of usable funds and its nothing to do with youth football!’

Bizarrely it’s that committee which seems desperate to dispense with cash – cash raised in good faith for the Youth Academy by hundreds of Morton minded folk – the vast majority of whom have nothing to do with the Trust, and in addition, while the Youth Academy is still trading!! The assets merely lie in a ‘holding’ account. The Company Directors may (within strict guidelines) dispose of residual funds, but only on formal dissolution. That money – quite simply – DOES NOT BELONG TO THE TRUST.

Meanwhile ‘Auld Nick’s yet again been whipping himself into a frenzy over  ‘certain parties’ who are allegedly ‘attempting to denude the Trust of usable funds.’
In an Academy context, that committee and nobody else appears desperate to meekly hand over to commercial enterprise funds which the Trust doesn’t even own. 


WHY?..
…and perhaps more to the point, WHY is Trust Chairman and Academy director Stuart Duncan still body swerving  legitimate questions?

WHAT HAPPENED TO THE 

ACADEMY, MR. DUNCAN?


WHY did the club ‘opt’ to go with John Laird’s set up, knocking back a superb initiative for which many folk willingly parted with hard earned cash? Those folk did not expect now to be hearing ‘Chinese whispers’ suggesting that they may have been ‘conned’. 


Those folk deserve to know what happened, Mr. Duncan, and in particular why after all your hard work did you get ‘the bum’s rush’ from ‘Auld Shoogly’? 

Could it have anything to do with this potential headline?

DIRECTOR FOUND GUILTY OF DEFAMATION


Those who are attempting to denude the Trust of usable funds are a few blinkered and insular committee clowns who have thrown caution to the winds in pursuing a ‘non- starter’ court action ON THE ADVICE OF MR. ROBINSON – and that in a futile attempt to cover Duncan’s arse over the ‘Stars of ’79’ fiasco.

They were told that they required legal representation – that it could cost the membership a pretty penny. THEY CANNOT CLAIM THAT THEY WERE NOT WARNED – but they have battered on regardless,  deliberately hiding their lunatic actions from a membership  which has given them absolutely no mandate.

‘Piniccio’ – ironically self described on the Trust forum as ‘A lying Nazi figure fiddler’ – still refuses to explain an apparent deficit of £1510 in ticket income on the part of his fellow sub- committee member Sean Donnelly – that despite a documented and unequivocal promise to the contrary. 


Are Robinson and his sidekicks DELIBERATELY harbouring a criminal?  Auld Nick had better come up with a damned good explanation for that omission or in the prophetic words of Dunco the Clown ‘It may yet again become a Police matter’…. and of course the whole thing’s still ‘on hold’ with  I.C.A.S. pending that long overdue report from the sub committee of three set up to examine apparent discrepancies in the ‘Stars’ finances – a committee comprising of ROBINSON, MCCORKINDALE AND DONNELLY.

Anyhow Mr. Robinson, good Sir, here IS what ‘everyone’ knows:
You and your fellow committee members have DESTROYED the Trust – at least in its present form. Your collective behaviour in this matter has been unspeakably misguided, particularly when you all knew almost a year ago of internal problems which required resolution if the ‘Stars’ farce was ever to be put to bed.




MANIPULATION OF MONEY RAISED FOR DUNCAN’S ACADEMY

 If folk tossed their hard earned cash into every collection can thrust in their faces they’d soon be stony broke. 

‘Charity – it is said – begins at home.’

Most people give to a charity in one form or another. Some are selective,  pledging money on a monthly basis, others help their ‘good cause’ by active involvement in fund raising, many contribute via the National Lottery, and most drop the occasional coin into that ubiquitously rattled can.

Irrespective of the manner of donation, people contribute to a charity on the basis of goodwill and trust. They fully expect their cash to reach the intended target.

The raison d’etre of The Greenock Morton F.C. Inverclyde Football Academy Ltd. – a firm actively registered at Companies House – is to nurture local talent AS A REGISTERED CHARITY.

According to one of the Academy directors:

‘In total the Trust have £5600 which will be donated to the Youth Academy plus whatever is made for the Fans Game this year. Hopefully we will have over £10000 to donate, which is a fantastic effort by everyone involved. That should give a big boost to the Academy bank account which will be set up once the agreement between the Club and the Academy is in place. 


The only reason the Academy account has not been set up is purely operational……..The money is not “lying somewhere in someones bank account” its in the Trust account and will stay there until it gets used for the purpose for which it was raised.’

‘The money raised from the 2010 Fans Game will join it until it gets used for the purpose for which its being raised.’


Powerful  and reassuring stuff, and there cannot be a shadow of doubt that the good folk of Inverclyde who raised money for the Academy did so in the firm belief that the proceeds would end up IN THAT ACADEMY ACCOUNT.

‘All monies raised by the Trust at Trust organised events belongs to the Trust. There is no such thing as “Academy Money”.



There is, however, such a thing as the 

Academy. 


The Greenock Morton F.C. Inverclyde Football Academy Ltd. is ‘active’ at Companies House with its next accounts due for submission early in June….
…and there IS such a thing as the sum of over £10,000 which has been generated for it by Morton folk  – ON THE EXPRESS UNDERSTANDING THAT IT WILL BE USED FOR THE PURPOSE FOR WHICH IT WAS RAISED.

Only as and when the Greenock Morton F.C. Inverclyde Football Academy Ltd. has been formally dissolved may the Company directors (NOT THE TRUST) decide what best to do with that cash, and they must adhere to the strict guidelines laid down in Company Law.

Mortonjag sees no reason why that money should not be allocated to an alternative youth programme… 

…provided there is no objection from those who 

raised it FOR THE ACADEMY. 

The Charities Commission provides helpful advice for such situations.

The following statement by Trust Chairman and Academy director Stuart Duncan is unhelpful and thoroughly misleading:

‘Morton chose to go with the youth set up proposed by John Laird. The organising of the Youth Academy was taken to a point where it could be “parked” without the requirement to take it any further and with no costs attached.’ 

Using that motoring analogy, limited companies are not ‘parked’! They either run or they’re scrapped! The Academy is still ‘running’ and while that situation prevails the money cannot be touched.

It will serve the best interests of all concerned if this matter is dealt with promptly and by proper procedure. Unfortunately ‘leopards do not change their spots’.

Accounting records shall be kept in accordance with all applicable statutory requirements and such accounting records shall, in particular, contain entries from day to day of all sums of money received and expended by the company and the matters in respect of which such receipt and expenditure take place and a record of all the assets and liabilities of the company; such accounting records shall be open to inspection at all times by any director of the company.

Mr Duncan very well knows that the spotlight is on him after it emerged that the Trust committee may have been involved in some dubious negotiations in an attempt to dispose of money raised by Inverclyde folk for the Inverclyde Football Academy.

The Academy is an active company and registered as such at Companies House. The next accounts are due in just over one month.

‘I don’t think there is any great secret, as such. The Academy didn’t launch, as the club opted to go with John Laird’s set up. I think, in truth, you’d have to ask the club to explain their thinking behind that. Perhaps Stuart will be able to say something more about it at the Trust a.g.m.. Regardless, the decision left the Trust with money designated for a purpose that was unlikely to be fulfilled. We’re now actively looking at alternative ways the money can be invested in the club, albeit this is at an early stage’.

They did so in the firm belief that it would be independent of the Club in all but red tape. They mistakenly believed that it was in the hands of trustworthy people.

WHAT MANDATE DID THAT LOT SEEK FROM THE MEMBERSHIP FOR A FIFTEEN MONTH PERSECUTION OF JIM GALLACHER IN AN ATTEMPT TO COVER CHAIRMAN DUNCAN’S BACKSIDE AFTER THE POLICE SENT HIM PACKING?….
AND
AFTER THEIR LATEST HUMUNGOUS ‘COCK UP’ WHICH LEAVES THE TRUST WITH A POTENTIAL LEGAL BILL OF BETWEEN £5000 AND £10000
WILL IT FINALLY PENETRATE THEIR THICK SKULLS THAT THEY ARE 
CONSTITUTIONALLY BOUND TO  INFORM THE MEMBERSHIP OF ALL ISSUES OF NOTE, TO CANVASS THE VIEWS OF THAT MEMBERSHIP AT ALL TIMES, AND TO IMPLEMENT THE WISHES OF THE MEMBERSHIP AS A WHOLE?

RE BEING ‘CONNED’ BY GILL

ALL THE WAY TO A PENALTY SHOOT OUT?

Mortonjag’s blog entry this morning is very serious, and is specifically for the attention of Paul Gill and his fellows on the Trust Committee. There are no photographs, irony, sarcasm, or ‘smileys’, and everything is said with absolute sincerity.

Yesterday Paul used an event totally unconnected with Mortonjag in an attempt to censor this blog. That is perhaps understandable when Mortonjag has been so brutally critical of the Trust Committee, but Mortonjag does not blog by choice. It is his only means of voicing opinion and of asking questions of the Trust Committee – specifically regarding their handling of the ‘Stars of ’79’ business. For that reason Mortonjag will continue to exercise his right to freedom of speech through this medium until dialogue is again entertained.

The background to all of this is well known by those who care for the Trust, including a number of fellow members who regularly correspond with Mortonjag. The blog was born because Mortonjag was banned from greenockmorton.org, something which was done in an attempt to silence him regarding the ‘Stars of ’79’ business. 

Several weeks ago and by mutual agreement, mention of the Trust Committee disappeared from the blog while ‘negotiations’ were taking place. Those ‘negotiations’ were sanctioned by the current Chairman, Stuart Duncan, and facilitated by Paul Gill.  Mortonjag made it crystal clear at the time that he was not acting for any individual – that he simply wanted the matter concluded and justice seen to be done – for the benefit of the Trust.

After multiple emails and several telephone conversations, lengthy face to face discussions finally took place between Mortonjag and two separate Committee members. During and after those meetings information was provided for the Trust Committee on a bona fide basis, that being the explicit understanding that the ‘Stars of ’79 business’ would finally be ‘sorted from within’, allowing everyone to move on.

At a subsequent Committee meeting the information was examined as were several points and questions put in writing by Mortonjag. An email had been sent to the new Committee members immediately prior to the meeting in which Mortonjag explained his stance in frank detail, expressing serious reservations about the future of the Trust unless certain matters were addressed urgently.

Immediately thereafter  Mortonjag was informed officially that no further communication was invited. The Committee had  ‘examined all of the evidence’. They were united on the  handling of the ‘Stars of ’79’ issue and agreed on the way ahead. 


No satisfactory explanation was given for the unheralded ‘silence’ except a claim that potential legal action prevented dialogue. NO LEGAL PROCEEDINGS BY EITHER ‘SIDE’ WERE CURRENT AT THE TIME OF THAT MEETING.


Mortonjag is firmly of the opinion that exactly the opposite should have applied – certainly if the Committee had any intention whatsoever of reaching an early settlement. Bizarrely, having suggested that ‘all of the evidence had been seen’ BEFORE coming to their decision the final sentence appeared somewhat contradictory:


If you believe that you have firm evidence to refute the board’s position it would be in everyone’s interest if that could be made available for our further consideration’.


That  came across as arrogant, dismissive, and frivolous, given that communication had already been severed. The new members had apparently embraced the philosophy of their predecessors.


Meanwhile Paul Gill intimated that ‘he would not be returning emails or ‘phone calls’, and it was made clear that any correspondence to any Committee member had to be be copied to all of the others. 

Faced with an impasse, and persuaded that the ‘negotiations’ had been nothing other than a shameless abuse of  trust, Mortonjag was forced to revert to blogging.

To date there has been no response to the points and questions put to the Committee as a member, in good faith, and on the very clear understanding that ‘matters would be sorted from within’.


As there is an apparently unexplained deficit in the Trust’s accounts which Mortonjag had asked to be addressed at that meeting, Mortonjag wrote to the Committee requesting details of the latest annual return. The rules clearly specify that that MUST be provided on request Two letters have been delivered. Neither has  been acknowledged. Meanwhile a warning has been received from the Secretary, indicating that Mortonjag may be expelled from membership at the forthcoming A.G.M. for allegedly making ‘detrimental comments about the Trust on his blog and on greenockmorton.org’. 

It is abundantly clear that the Trust cannot move forward until the ‘Stars of ’79 business’ is finalised. The ‘current relaunch’- albeit well intended – is surely doomed while legal actions real and threatened are ongoing.


In terms of litigation members should understand that the Trust Committee set the ball in motion. All subsequent legal intervention has been a direct result of Trust Committee actions/inaction.

Yesterday Paul Gill brought things to a head with his specific request to Mortonjag to modify the blog. Mortonjag has always been happy to entertain mediation but ‘it takes two to tango’. 

Accordingly, and for the second time, Mortonjag offers to assist the Committee in an attempt to resolve the ‘Stars of ’79’ issue. That must inevitably involve dialogue.

A sincere invitation is extended to each member of the Trust Committee (and indeed to the Committee as a whole) to communicate with Mortonjag as soon as possible. Any realistic suggestion aimed at bringing the matter to an early conclusion will be treated with respect and in absolute confidence. Because of ongoing damage to the Trust while things remains unresolved, Mortonjag considers this matter urgent and his offer will expire at midnight on 28th July.

Hopefully the ‘Stars of ’79’ issue need not go all the way to a penalty shoot out!

Paul Gill has been getting upset again…. SO upset in fact, that this afternoon he posted the following on his official Trust message board IN FULL VIEW OF HIS GRAND TOTAL OF THIRTY SEVEN SUBSCRIBERS:
 You’re a nasty little old man really aren’t you with an obvious sad existence of a life that you just spend every minute of every day hiding behind your blog taking pot shots at Trust Board members?


Mortonjag found that a little hurtful as he and the Monkey had quite been looking forward to meeting Mr. Gill again at Greenock Sheriff Court last Monday but he was nowhere to be seen!


Subsequently his posting was altered to terminate with:


‘What I have to say, I will say to your face and all in good time.’


WHY THIS SUDDEN CHANGE OF HEART AFTER EIGHT MONTHS MR. GILL? HAS SOMETHING HAPPENED TO UPSET YOU, OR HAVE YOU SECRETLY BEEN PINING FOR ANOTHER OF THOSE LONG AND AMICABLE CHATS?
