An extremely serious blog this evening, and one which will hopefully be read by all TRUE creditors of Mr. James Gallacher of 22 South Street, Greenock.
The committee of The Greenock Morton Supporters’ Society Ltd. is guilty of a shameless SCAM in an attempt to escape justice. They have had their Small Claims action against Mr. Gallacher sisted (suspended) in order to have a parallel claim considered under a protected Trust Deed he signed for the benefit of his TRUE creditors, and two points should be considered by ALL who have an interest in Mr. Gallacher’s Trust Deed, or in the ‘Stars of ’79’ fiasco.
Firstly, the Trust committee has deliberately REJECTED a bond which guarantees full payment of their claim and maximum costs should it win the court action. At first sight there appears to be NO logical reason for rejection, and details have been hidden from the membership. The bond remains in place should the Trust wish to sign a minute of agreement.
Secondly – if the Trust’s claim is not decided by the court, Mr. Gallacher’s Trustee will be forced to establish its validity. ‘The costs of such a complicated exercise are likely to devour all of the money in the ‘kitty’.
THIS DELIBERATE SCAM WILL LEAVE NO DIVIDEND FOR MR. GALLACHER’S TRUE CREDITORS, LET ALONE FOR THE TRUST, WHICH WILL NOT GET A ‘BRASS FARTHING’.
Nick Robinson the Trust Chairman and the brains behind this outrageous SCAM is a licensed Insolvency Practitioner, who, according to the Trustee, ‘knows full well that the Trust’s best chance of getting any money back is to allow the Small Claim to proceed’, and of course Robinson also knows full well that the Trust is unlikely to get a penny from the Trust Deed even if its hitherto unproven claim is ultimately validated.
The Trustee must consider fully ALL claims (true or fraudulent), and that is normally done at the end of the Deed term – almost three years away.
Robinson imagines that three years down the line the ‘Stars of ’79 fiasco’ will long since have been forgotten. That is the ‘reasoning’ behind this bizarre action.
THE SISTING OF THE GREENOCK MORTON SUPPORTERS’ TRUST’S SMALL CLAIM AGAINST JIM GALLACHER IS A DELIBERATE ATTEMPT TO DEPRIVE HIS TRUE CREDITORS OF THEIR RIGHTS UNDER HIS PROTECTED TRUST DEED – A WICKED AND IMMORAL SCAM, KNOWINGLY DEVISED BY A LICENSED INSOLVENCY PRACTITIONER, AND DESIGNED TO GET THE TRUST COMMITTEE OFF A LEGAL HOOK OF ITS OWN MAKING – BECAUSE ROBINSON IS TERRIFIED OF A PROOF HEARING OF HIS VERY OWN ‘OPEN AND SHUT’ CASE!
Robinson and Trust Secretary Chris McCorkindale repeatedly announced in various media last November that the case ‘could NOT be heard for legal reasons – but THEY HAD ALREADY BEEN INFORMED IN WRITING (IN OCTOBER) THAT MR. GALLACHER’S TRUSTEE HAS NO INTEREST IN THEIR SMALL CLAIMS ACTION – THAT IT MAY PROCEED UNHAMPERED BY HIS TRUST DEED! DID ROBINSON AND MCCORKINDALE DELIBERATELY DECEIVE THE TRUST MEMBERSHIP AND THE PUBLIC?
Meanwhile the face behind the SCAM – Licensed Insolvency Practitioner Nicholas Robinson C.A., who operates as ‘Practiser’, of 4 Burns Drive Wemyss Bay, continues to spout self righteously on the unofficial fans’ website:
